Motion practice is at the center of civil litigation. To be effective, litigators at all levels of experience must have a firm grasp on the procedural and substantive issues affecting each potential motion. Understanding the bedrock legal principles and recent developments in the law and court rules is crucial both to evaluating whether to recommend making a contemplated motion and to making and opposing motions effectively. This distinguished panel will provide guidance on how to decide whether to file a motion, when to file it, how to persuasively make and respond to motions, and tips for effective oral argument. This program will primarily cover motions for expedited relief (temporary restraining order, preliminary injunction), motions to dismiss, summary judgment motions, discovery motions, and motions to seal. The panelists will provide expert insight and guidance to help you foster and hone the motion practice skills necessary to succeed in civil practice in New York State and Federal Courts.
