Description
Technology, our increasing interconnectedness and the "sharing economy" have had a dramatic impact on the real estate world, as they have on most other facets of American life. On a practical level, most New Yorkers experience this new reality most concretely via the proliferation of short-term rentals through AirBnB and other similar websites. However, the increasingly common use of residential apartments for short-term stays has prompted a strong reaction by tenants' groups, affordable housing advocates and the hotel industry, among others. This reaction has led to a series of laws meant to curtail short-term rentals in New York City - including, most recently, a New York State law enacted in October, 2016 prohibiting the advertisement of residential apartments for stays of under 30 days. Additionally, New York courts have, in general, not looked kindly upon owners and tenants who have violated these laws. This program will explore and analyze the changing legal landscape of short-term apartment rentals in New York City, including, among other things, a review and analysis of the laws now on the books, an examination of recent case law on the topic, and what the future may hold for this burgeoning - but highly controversial - industry.
