Description:
Please join us for a panel discussion on hot topics and recent decisions impacting plan confirmation in business reorganizations. The panel will discuss the unique plan confirmation issues that have arisen from recent case law and practice in mass tort bankruptcies and bankruptcies following liability management transactions, as well as legal developments relating to the appealability of bankruptcy court orders. The panel will cover: (i) developments in case law regarding whether and when financial distress is a requirement to establish that a filing was made in good faith, (ii) classification of claims for the purpose of plan confirmation, (iii) bankruptcy judges as arbiters of intercreditor disputes arising out of pre-petition liability management transactions and (iv) appeals of bankruptcy court orders and their impact on the larger case.
