Description:

In April 2022, the New York Court of Appeals issued a decision in Nemeth v. Brenntag North America, 38 N.Y.3d 336 (2022), overturning a $16.5 million verdict in a case involving exposure to asbestos-contaminated talcum powder, and revisited New York’s causation standards for the first time in a while. Now that one year has passed since the issuance of Nemeth, our panel will provide a historical overview of New York’s causation and expert standards, a detailed discussion of the Nemeth case and how those standards were applied, and the future of causation and expert evidence in the post-Nemeth world.
