Description:
Join us for a discussion of the opportunities and potential pitfalls in bringing claims based in the New York State Constitution. Our panel of experienced litigators will address a number of questions, including: should plaintiffs be looking to the State Constitution as a source of rights; which provisions have a private right of action, and which do not; how can litigants use the provisions unique to the State Constitution, like the right to an education, to advance their goals; what changes to State law would increase the efficacy and the scope of State constitutional provisions; and what new opportunities does the Equal Rights Amendment create for civil rights plaintiffs.
