This CLE will explore New York State’s public nuisance law which now permits lawsuits against firearm manufacturers. Panelists will explore how to file a lawsuit against a company engaged in the manufacture or distribution of firearms. Emphasis is placed on the ‘nuts and bolts’ of a lawsuit and what practitioners should anticipate from both the plaintiff and defense perspective. Topics to be explored include pleadings, what practitioners must allege, who may file suit, and what entities may be named as defendants. Panelists will also discuss the discovery phase including depositions, interrogatories, and record demands. This program does not focus on constitutionality.
