Description: 
Tax planning in the context of estate planning in many instances focuses less on wealth transfer planning (estate, gift and GST taxes) and more heavily on the income tax-free step up in basis at death for most assets. The IRS has expressed its view in Rev. Rul. 2023-2 that a step up in basis generally applies only to assets included in the decedent’s gross estate, but is this analytically correct in the case of a grantor trust? Moreover, there is, as a practical matter, a way to obtain a step-up in basis for assets in a grantor trust even if the trust is not included in the grantor’s gross estate. In this year’s City Bar Mortimer Hess Memorial Lecture, Jonathan Blattmachr will explain how to have assets excluded from a grantor’s gross estate but still obtain the tax-free step up in basis at death. Jonathan’s presentation will also cover a bit of the history of the income tax step up in basis at death and delve into some of the complexity of section 1014.

Hess, is made possible through a generous grant from Mr. Hess’s family and former partners. The subjects of the lectures are related to the law of trusts, estates, and taxation, subjects on which Mr. Hess was an acknowledged authority.
