The State of Play in Investor State Arbitration: Are We In for the Roaring 20s or the Big Crash?

Description:
On January 29, 2020, President Trump signed the United States-Mexico-Canada trade agreement which will substantially remake the investor state dispute settlement treaty provisions between the US, Mexico, and Canada. This happened against the backdrop of an ongoing debate as to whether investor state arbitration should be “judicialized” (i.e., parties should not be able to appoint arbitrators), an increasing trend toward relying upon third party financing by claimants, tight budgets by sovereigns, and criticisms stemming from a lack of diversity. Some may argue that investor state arbitration is in decline. Maybe it’s fairer to say that investor state arbitration is at a turning point. The panel will address all of these issues, career paths and prospects in international investment arbitration and what to expect in the future of investor state arbitration
