The Joint DOJ/FTC Merger Guidelines were issued on December 18, 2023. They reflect a major change in the agencies’ approach to merger analysis from the guidelines that were in effect since 1982, and it is critical for antitrust and M&A practitioners to understand them.
Our primary speaker will be David Lawrence, Policy Director for the Antitrust Division of the Department of Justice, one of the primary drafters of the Guidelines. He will be followed by two antitrust premerger practitioners and an antitrust economist who will raise questions designed to bring out changes from prior practice and challenges in complying with the new Guidelines. The program is addressed both to lawyers who wish to acquaint themselves with the new Guidelines and to advanced practitioners with interest in more detailed antitrust and economic issues related to antitrust merger analysis.
