Description:
New York City is among the highest valued real estate markets in the US and many a family home is an easy target for investors and scammers alike to profit from equity built up over generations. New York State is about to enact a new electronic notarial law that has protections against deed fraud and recently enacted a modified version of the Uniform Partition of Heirs Property Act (RPAPL 993) to address a recently identified trend of using partition law to strip equity from residential property, often in communities of color that have been subject to past discriminatory practices. This CLE will discuss the purpose and basics of these new laws, their implementation and other forms of equity stripping schemes and potential real property fraud with a focus on keeping families in place and preserving communities.
