State and federal banking regulators continue to push new laws and regulations in financial services. State attorneys general are also actively pursuing initiatives within their states in collaboration with their federal partners. From this there has been an increase in litigation, focused on credit reporting, debt collection, and Unfair Deceptive Acts or Practices/Unfair Deceptive and Abusive Acts or Practices (UDAP/UDAAP). Join us and our esteemed panelists for an in-depth discussion on these current hot topics and learn more about the new changes in consumer financial services.

Panel 1 – An Overview on Federal Unfair, Deceptive, and Abusive Acts or Practices (UDAAPs)

This panel will quickly provide an overview of the history of the Federal consumer protection law Unfair and Deceptive Acts or Practices (UDAPs) from its inception with the FTC Act of 1914 to its transformation with the Dodd-Frank Act of 2010 into Unfair, Deceptive, or Abusive Acts and Practices (UDAAPs). The individual standards for unfair, deceptive, and abusive acts or practices will be reviewed, culminating in the latest update to the Abusive Standard policy promulgated by the Consumer Financial Protection Bureau.

Panel 2 – A Primer on New York Debt Collection Law and Regulation

New York has some of the most expansive regulation of consumer debt collection in the US. In addition to the New York Department of Financial Services, the NYC Department of Consumer and Worker Protection regulates consumer debt collection in the five boroughs. And with the adoption of the New York Consumer Credit Fairness Act in 2021, New York has made significant changes to how debt collection lawsuits can be brought. This panel examines these laws and regulations, recent legislation impacting medical debt, and what legislators and regulators have in store for the near term.

Panel 3 – NYS CFS Laws/Lending Litigation Updates

The examination of litigation and regulatory trends involving consumer lending.
