Electronic information permeates our society in ever increasing
volumes and varieties. In this time of COVID-19, when social distancing
and offices are or have been closed, the ability of lawyers to work
remotely with clients, courts, and adversaries – and to promote
themselves – has become vital, and that ability should be expected to
increase as work habits change. This two-part webinar will address
ethical concerns for lawyers arising out of remote work and will also
focus on security requirements that attorneys should understand and
implement using the NY SHIELD Act and other laws which they and their
clients might be subject to. Part One, the first hour, will look at
competence, confidentiality, and supervision issues for attorneys, as
well as ethical implications raised by attorney use of a checklist for
working remotely. Part Two, the second hour, will look at security
requirements under the SHIELD Act and will also provide an overview of
other laws. Questions will be taken throughout both parts.
