Broken PROMESA? Democratic Accountability and Governance in Puerto Rico

Description:
The Financial Oversight and Management Board for Puerto Rico was created under the Puerto Rico Oversight, Management and Economic Stability Act of 2016 (PROMESA). The Board consists of seven members appointed by the president from lists prepared by congressional leaders and who can only be removed "for cause." In early October, the Supreme Court heard oral argument in
UTIER v. Financial Oversight and Management Board for Puerto Rico
in which bondholders and unions, with the support of a cross-ideological coalition of amici, are challenging the constitutionality of the Board member’s appointments. Specifically, the challengers allege that the Appointments Clause of the U.S. Constitution requires that the U.S. Senate confirm high-level federal officers and that the board members were within the scope of this clause. This panel will discuss the potential outcomes of the Utier case and its implications for Puerto Rico's status, right to democratic governance and the restructuring of the island's debt.
