Description:
Negotiation is one of the most important skills a lawyer can possess. Lawyers negotiate constantly whether it is a transaction, the settlement of a litigation matter, or a fee agreement. All lawyers negotiate. Not all negotiate effectively. Everyone’s negotiation skills can be polished and results improved with science-based training.
This course is for the experienced as well as the novice negotiating attorney. The experienced negotiator will become more mindful and deliberate by acquiring a conscious understanding of what works and why. The novice negotiator will learn the newest and most effective framework for conducting negotiations. This course will explore the essential keys of effective negotiation, developing a negotiation plan, managing a negotiation, and closing the deal.

Joan Stearns Johnsen, Master Skills Professor, University of Florida, Levin College of Law
Joan Stearns Johnsen teaches negotiation, mediation, and arbitration at the University of Florida Levin College of Law. Additionally, Joan is on the panels of the American Arbitration Association, FINRA, CPR, the National Futures Association, the New York Supreme Court, Commercial Division, and Resolute Systems. Joan is a Fellow of the Chartered Institute of Arbitrators and is certified by the International Mediation Institute and accredited by CEDR. Joan is a frequent speaker and trainer on best practices in deal facilitation, negotiation, mediation, and arbitration and has published numerous articles and papers on these subjects. Her legal practice experience includes as in-house counsel for Smith Barney, as the associate general counsel for the Commodity Exchange, Inc., both in New York city, and as an enforcement attorney for the Commodity Futures Trading Commission in Washington, D.C. Joan is active in the Dispute Resolution Community. She is a past Chair of the ABA’s Section of Dispute Resolution, on the Counsel of CPR, Vice Chair of the Mediation Committee of the International Bar Association, and a Board Member of the Miami International Arbitration Society. Joan is the 2022 recipient of the International Institute for Conflict Prevention and Resolution (“CPR”) James P. Groton award for Outstanding Leadership in Dispute Prevention.
