Description:
This CLE program aims to provide an overview of New York Surrogate's Court litigation, covering topics such as obtaining jurisdiction over all necessary parties, the role of court attorney-referee mediation, discovery pre- and post-objections (e.g., SCPA 1404), hearings, drafting and filing motions, affirmations in support/opposition, cross-motions, types of motions, when to file an Order to Show Cause, submission of proposed orders and decrees, and notes of issue. The overall goal is to provide newly admitted attorneys, and attorneys inexperienced with Surrogate's Court, with a comprehensive understanding of practicing in this specialized court.

For New York Newly Admitted Attorneys: Skills credits completed after December 31, 2025, must be completed in the traditional live classroom setting or by fully interactive videoconference.
