The judiciary and policymakers have eroded privacy protections even as surveillance and data sharing are increasingly omnipresent. Twelve states currently recognize an explicit constitutional right to privacy, and New York is now considering joining them through the proposed New York Privacy Amendment (S8603/A8377) (Ramos/Shimsky). Modeled on the most robust state constitutional protections—including those in Alaska, Hawaii, and Washington—the proposed amendment would establish an expansive constitutional foundation for protecting decisional privacy, limiting surveillance, and safeguarding sensitive personal data.

This panel will examine the structure, scope, and potential impact of the proposed amendment. Panelists will discuss how constitutional privacy provisions have operated in other states and how similar language in New York could strengthen protections for decisional and bodily autonomy, restrict government surveillance, and provide guardrails for the collection, use, and sharing of sensitive personal data.

The discussion will also explore how the amendment intersects with emerging legislative and policy efforts addressing surveillance technologies, corporate data practices, and interstate information sharing. Panelists will conclude by identifying concrete opportunities for engagement, including legislative advocacy, regulatory participation, and strategic litigation, through which lawyers, bar associations, and civil society organizations can help shape the future of privacy protections in New York.
