Description:
More and more, companies are using promotional tools including sweepstakes, skill contests, and social media and digital marketing and hybrid versions thereof, all while struggling to keep pace with the speed of technological change on new platforms and technologies delivering these programs. Social media laws applying to posting and tweeting in “real-time marketing, new privacy restrictions from California Virginia and Colorado and other states on data driven advertising, NFTs”,Dark Pattern “ restrictions raised by the FTC, and other concerns are rapidly changing or challenging the advertising/privacy/Intellectual property ecosystems The collection and use of data, and the enormous increase of privacy-related issues, raise complex questions and issues for the practicing bar.

In this program, experts in the field will address the critical issues that arise when offering games and other promotions relevant to today’s marketplace. Topics to be discussed include the laws and rules governing sweepstakes, skill contests and other promotions on the new platforms; compliance with the laws governing real time marketing , NFT’s and intellectual property, influencer marketing; the continued import of the FTC endorsement guides; a wealth of new material on privacy, dark patterns concerns and children’s marketing.
