This program examines the recently enacted New York State Equal Rights Amendment (ERA) which amends the New York Constitution to expand protections against discrimination on the basis of ethnicity, national origin, age, disability, and sex—including sexual orientation, gender identity and expression, pregnancy, pregnancy outcomes, and reproductive healthcare and autonomy.
Designed to equip legal practitioners with tools to effectively leverage the ERA, this program will provide an overview of the amendment’s history and intended scope. The session will include a focused analysis of the ERA’s application to reproductive rights, addressing both foundational and emerging issues likely to arise in litigation before New York State courts.
Participants will explore the ERA’s protections as they relate to reproductive healthcare, including pregnancy and pregnancy outcomes, and will consider how these constitutional provisions interact with existing New York statutory frameworks. The program will also situate reproductive rights within broader legal principles of equality, autonomy, and anti-discrimination, offering practical insights for both litigators and other practitioners seeking to advance these protections.
