Description:

The program will provide an overview of significant developments in the practice of elder law during and at the end of the Covid-19 Public Health Emergency. Judith D. Grimaldi, Partner, Grimaldi Yeung Law Group, will provide a refresher on the 2021 changes to the New York Statutory Short Form Power of Attorney and suggested modifications for long-term care and/or incapacity planning; discuss current challenges to Medicaid Asset Protection Trusts and offer tips on drafting; and briefly review the anticipated changes to the Medicaid home care rules. Peter Travitsky, Associate Supervising Attorney, NYLAG, will highlight the importance of completing Medicaid redeterminations as the Public Health Emergency unwinds and outline the steps for applying for Medicaid home care, including navigating the New York Independent Assessor process. The program will also feature a presentation on elder abuse and its surge during the pandemic and addressing elder abuse situations.

For New York Attorneys: Newly admitted attorneys (those admitted to the New York State Bar for two years or less) may participate in Skills CLE courses in  live, nontraditional formats, where questions are allowed during the program (through June 30, 2023 per recent guidance of the CLE Board – for more information, click here).
