Description:
The COVID 19 pandemic has put a large stress on commercial leasing in NYC. Many tenant businesses have been closed and have not earned the expected income to pay the rent. This CLE will explore the legal ramifications of this pandemic. First, we will discuss the impact of certain executive orders and legislation enacted during this crisis affecting landlords and tenants. Next, we will explore some of the lease provisions that can impact a tenant’s remedies and applicable case law. Also, we will overview how some tenants are sorting out these issues through negotiation. Immediately major retailers such as Victoria’s Secret and Valentino have filed suits to get out of paying rent. This CLE will explain and help navigate the litigation system and explore possible outcomes. Attendants will be better able to address their clients and their own leasing concerns arising from the Covid -19 crisis.
