Introduction to the Surrogate's Court: Wrongful Death Compromise Proceedings

Description:
This CLE program aims to provide a practical overview of navigating wrongful death settlement compromise proceedings in the New York Surrogate's Court. The presentation will cover essential topics such as drafting and filing petitions for compromise, obtaining jurisdiction over all necessary parties (including distributees, the NYS Department of Taxation and Finance, and statutory lienholders), and allocating settlement proceeds between wrongful death and conscious pain and suffering. Additionally, the program will address the application of the Kaiser distribution formula, attorney fee approvals under 22 NYCRR 207.45, resolving medical and Medicaid liens, the appointment and role of a Guardian-Ad-Litem, and submitting proposed compromise decrees. The overall goal is to provide young attorneys, and attorneys inexperienced with Surrogate's Court practice, with a clear, step-by-step roadmap for handling wrongful death compromises from petition to final distribution.

For New York Newly Admitted Attorneys: Skills credits completed after December 31, 2025, must be completed in the traditional live classroom setting or by fully interactive videoconference.
