Description:
This program will address ethical, practical and risk management issues for lawyers arising out of cybersecurity and data breaches. We will discuss the ethical obligation for lawyers to protect and preserve client confidential information and prevent data breaches, and the professional liability implications for lawyers who fail to act diligently to preserve and maintain client confidential information. We will discuss the implications for lawyers of the new cybersecurity regulations by the New York Department of Financial Services, and whether lawyers are “third party vendors” within the meaning of the regulations. We will examine what lawyers should be doing to preserve data security, including confidential customer information. We will also cover recent trends in insurance claims against lawyers, and what lawyers can do to maximize insurance coverage for cyber risks.
