Every executor, administrator, and trustee eventually faces a decision consequential enough that any choice invites a later surcharge claim judged with the unforgiving clarity of hindsight. SCPA § 2107 offers a powerful answer: the fiduciary can petition the Surrogate for advance direction on a contemplated course of action and, through substantial compliance with the resulting decree, gain statutory protection against claims that the estate suffered a loss.
 
But the proceeding is a narrow one, and a petition that strays into asking the court to substitute its judgment for the fiduciary's will be turned away at the threshold.  Through real-world hypotheticals and a candid discussion of the most common pitfalls, you will be able to counsel fiduciary clients with confidence and use § 2107 as the shield it was designed to be.
