Regulating Data Privacy in a World of Emerging Digital Health Technologies

Description:
The proliferation in recent years of digital health technologies, including mobile apps and wearable medical devices, has left broad swaths of consumer health data unregulated. Much of this health data is not covered by the Health Insurance Portability and Accountability Act (HIPAA), which applies narrowly to protected health information held by specific health care entities, including most health care providers. Federal and state legislators and regulators have begun filling this gap in U.S. health data privacy regulation by, among other things, proposing amendments to existing regulations and bringing enforcement actions over the unauthorized sharing of health data to third parties. In the past year alone, two U.S. states enacted the nation’s first ever laws specifically restricting the collection, use, and disclosure of consumer health data not covered by HIPAA. This program will cover the risks to consumers as well as challenges for regulators and digital health companies alike in navigating this increasingly complex compliance landscape.
