Description:

Chapter 15 of the federal Bankruptcy Code governs U.S. recognition of foreign insolvency proceedings and has become increasingly important in these times of international economic distress. The panel will discuss the evolution of Chapter 15 since its enactment 15 years ago. The panel will use the key cases of the past 15 years to explore issues regarding eligibility to commence a Chapter 15 case, recognition of foreign proceedings, relief that may be granted to a foreign representative before and after recognition, and coordination with courts in foreign jurisdictions. Following the panel discussion will be an opportunity for Q&A from audience members.
