Description:
In the past couple of years, there have been more and more regulatory standards limiting or even prohibiting the use of granted trademarks on selected food and beverage products due to public health policies. This panel will provide an overview of such standards and discuss recent trends in Latin America– including but not limited to Argentina, Chile, Dominican Republic, and Mexico where brand restrictions have been implemented, resulting in some cases in an absolute prohibition to use a registered trademark and, which have led, in some instances, to litigation. The panel will also discuss the INTA’s Brand Restrictions Study: “A View from Gen-Zers and Millennials” as well as industries where brand restrictions could be implemented in the future.
