Marketing and Advertising Law 2026

Marketing and Advertising Law 2026 (OnDemand)
Originally held on Wednesday, May 20, 2026 | 9:00 am – 12:45 pm

Description:
The speed of companies adopting and using promotional and advertising tools, including sweepstakes, skill contests, and social/digital marketing, has rapidly increased even more through vast technological changes, such as Artificial Intelligence (AI). Social media laws applying to posting, tweeting, the growing labyrinth of federal and state privacy restrictions, and Dark Patterns cases raised by the FTC, such as the proposed revival of the click-to-cancel rule are very challenging. These are all changing the advertising, privacy, and intellectual property ecosystems and raising complex questions and issues for lawyers practicing in several different areas, including gambling/sports betting and predictive marketing interplay.

In the program, experts in these fields will address and clarify the key issues for advertising and privacy practitioners, among others. Topics will include:
•     Law and rules dealing with sweepstakes, skill contests, and complicated other promotions on all the key platforms in media
•     The end of the click-to-cancel rule and the proposed revival in modified version by the FTC
•     The pushback in all regulations by the current administration in Washington
•     Tips on how to most effectively prosecute NAD claims
•     CARU, COPPA and the increased regulatory challenges across the country to what is appropriate for children and those deemed to be underage to view
•     Most important current and new developments in the body of AI law
•     Cause marketing, co-ventures, and state differences and concerns
•     The increased penetration of gambling, including by cell phone and tablets with respect to sports betting and predictive marketing
