Claude E. Ducloux, Board-Certified by the Texas Board of Legal Specialization in Civil Trial Law and Civil Appellate Law, and former Grievance Prosecutor for the State Bar of Texas (also licensed in CA and CO) and former Chair of the Texas Center for Legal Ethics will present a 60 minute power point covering:

  • The inappropriate use of social media by lawyers;
  • The necessary changes to law practice, client control and case selection due to use of social media;
  • Malpractice cases based upon inappropriate use;
  • Disciplinary cases resulting from use of social media;
  • Monetary damages which may result from use of social media;
  • Dangers of spoliation of evidence by modifying websites; and necessary instructions to clients concerning modifying social media history;
  • How inappropriate use destroys the attorney client privilege;
  • Ethical conduct concerning jurors and “false friending;”
  • ABA Ethics 20/20 and new Rule 1.1 requiring technical competency;
  • Whether lawyer blogs constitute advertising;
  • Developing case-law on “the duty to google;”
  • Lawyer’s danger of breaching ethical and fiduciary duty online; and
  • A survey of opinions issued by various bar associations.

This will be via a PowerPoint presentation, which will be made available to the participants. Presenter will answer questions, and provide follow-up to audience following the presentation.

Newly admitted attorneys in New York CANNOT earn skills, ethics, or cybersecurity-ethics credit for transitional on-demand courses but CAN earn credits in the areas of professional practice, law practice management, or cybersecurity-general if offered for this program.

For New York Attorneys: Effective through December 31, 2025 newly admitted attorneys (those admitted to the New York State Bar for two years or less) may earn skills credits in a traditional live classroom setting or through individual participation (self-study) or group participation, utilizing the following live, nontraditional formats where questions are allowed during the program (web conference, teleconference, video conference). After December 31, 2025, newly admitted attorneys must complete skills CLE credits in either the traditional live classroom setting or by fully interactive video conference group participation only (where participants are physically together in a group setting).  

For New York Attorneys: This program is a transitional/non-transitional course.
