Parties to a construction-project dispute have unique and particular enforcement remedies (and defenses). This program explores: enforcing and securing payment for work on construction projects, illuminating different aspects of the Lien Law and available defensive options; methods of calculating damages, including whether the "critical path method" is still relevant; proving and defending against construction contract causes of action, including performance/payment bond lawsuits; the different types of applicable insurance coverage; managing disputes without judicial intervention; and ethical considerations under the ABA Model Rules and the NY Rules of Professional Conduct.
