The Internet provides a rich source of information for jurors, lawyers, witnesses and the Court. Jurors and witnesses in criminal trials are instructed not to use the internet to conduct research or communicate about the case on trial. Attorneys, meanwhile, often use the Internet in jury selection, during trial and to gather information about witnesses or parties. And law enforcement often uses the Internet to investigate and prosecute crimes. In this “electronic age,” certain important and recurring practical and ethical issues arise, such as: Do jury instructions and other strategies actually prevent jurors from misusing the Internet? What are the ethical or legal boundaries in using the Internet during jury selection or to gather information about parties or witnesses? What are counsel’s obligations to disclose issues or concerns? Can attorneys use useful evidence found on the Internet as trial evidence? What pitfalls face judges who use social networking sites? This program will address these and other practical and legal issues.
