This program will address how, in a world otherwise transformed by information technology and increased competition, ethical rules developed in earlier eras continue to set important limits on what an attorney may do. The panel includes attorneys with deep experience in professional discipline, litigation and cyber-risk. The program will address:
Limits on covert techniques to elicit evidence in person or online;
Risk posed by use of inadvertently disclosed content or metadata, even if on notice to one’s adversary;
Representation of employees by employer’s counsel;
National (and global) law practice regulated by conflicting ethical rules of New York and other jurisdictions.
