With the Court of Appeals groundbreaking decision in Matter of Brooke S.B. v. Elizabeth A.C.C the definition of family in NYS has changed significantly, particularly for same sex couples.  In this post Alison D. legal climate, under DRL 70(a), who now has standing to seek custody and visitation? What is the standard? Is there a bright line rule? Is it within the jurist’s discretion? As a practitioner, how can you best assist your client?  As an attorney for the child, how can you best advocate their position?  These issues will all be explored, as well as the most current and up-to-date case law.
