New York's Offshore Wind Initiative: The Legal Path Forward

New York State is implementing an aggressive policy for the development of offshore wind.  To implement this policy, legal issues must be addressed with respect to the offshore projects and the significant onshore development that will be required to support the construction and operation of those projects. In addition, to be economically viable state-level procurement mechanisms will have to be put into place to allow developers to recoup the costs of deploying turbine arrays miles out in the Atlantic Ocean. The use of such procurement strategies raises a host of legal issues under federal law.

Two panels will be presenting at the conference to discuss these and other legal issues. The first panel will set the stage by providing an overview of the opportunities presented by offshore wind, the State’s master plan for the development of this resource, the onshore facilities needed to support offshore development, and legal framework governing procurement options. The second panel will address legal issues relating to offshore wind, including acquisition of federal leases, environmental review and permitting, admiralty issues, and labor matters.
