Description:
The Introduction to Surrogate’s Court Series offers an overview of key topics for attorneys navigating Surrogate’s Court matters. From understanding crossover issues in non-Surrogate’s Court practices, to demystifying the different types of “Letters” issued by the court, and addressing remedies for estate or trust mismanagement, this series provides practical knowledge and strategies for a variety of legal disciplines.
Part I: Surrogate’s Court for the Non-Surrogate’s Attorney
Thursday, January 23, 2025 | 1:00 pm – 2:00 pm
This program bridges the gap between Surrogate’s Court practice and common challenges faced by attorneys in other fields. Real estate, guardianship, personal injury, commercial, and matrimonial practitioners will gain insights into scenarios they might encounter while serving their clients. Topics will include continuing a business after the death of a shareholder/member of an entity, removing restrictions from Letters to sell parcels of real property and/or compromising wrongful death, personal injury, and VCF proceedings; derivative claims, handing over the reins from a final guardianship account, and handling the validity of a prenuptual agreement or questioning spousal right.
Part II: What are “Letters” in New York State Surrogate’s Court
Thursday, February 13, 2025 | 1:00 pm – 2:00 pm
This program covers the purpose of, and how to secure various Letters in Surrogate’s Court, including Letters of Administration, Letters Testamentary, Preliminary Letters, Temporary Letters, Limited Letters, Letters of Administration c.t.a., and Letters of Administration d.b.n.
Part III: How to Handle Estate or Trust Mismanagement
Thursday, March 6, 2025 | 1:00 pm – 2:00 pm
This program will cover the remedies available to the beneficiary/distributee of an estate or trust who suspects wrongdoing, including obtaining information, commencing a reverse turnover, suspending and/or removing the fiduciary, and compelling an accounting.
